April 10, 2026 Opinion or Order Filing 15 ORDER. The court has an independent obligation to assess whether it has subject-matter jurisdiction. Henderson ex rel. Henderson v. Shinseki, 562 U.S. 428, 434 (2011). In this removed action, Defendant bears the burden of establishing that all requirements for diversity subject-matter jurisdiction are satisfied. United Food & Com. Workers Union, Loc. 919, AFL-CIO v. CenterMark Properties Meriden Square, Inc., 30 F.3d 298, 301 (2d Cir. 1994) ("Where, as here, jurisdiction is asserted by a defendant in a removal petition, it follows that the defendant has the burden of establishing that removal is proper."). In situations where the complaint does not explicitly claim damages exceeding $75,000, the court may look beyond a complaint to review the notice of removal and other filings; if the court finds by a preponderance of the evidence that the amount in controversy exceeds $75,000, diversity jurisdiction exists. 28 U.S.C. 1446(c)(2)(B).Consistent with Connecticut practice, the complaint filed in Superior Court states only that the amount in controversy exceeds $15,000. ECF No. 7, at 13. Nor does Defendant explicitly allege that the amount in controversy exceeds $75,000. Id. at 2 (stating that "the amount in controversy potentially exceeds the sum or value of $75,000"). Defendant does not identify any facts to support its assessment of the potential amount in controversy. The court therefore cannot assess from this record whether the requirements for diversity subject-matter jurisdiction are satisfied.The parties are instructed to promptly confer regarding the amount in controversy. If Defendant believes that the amount in controversy exceeds $75,000, Defendant shall file an amended Notice alleging facts concerning this case that will permit the court to assess whether the amount in controversy exceeds $75,000. This Notice is due on or before May 15, 2026. If Plaintiff does not agree that Defendant's Notice supports a finding that the amount in controversy exceeds $75,000, Plaintiff shall move to remand within 21 days of the filing of Defendant's Notice. If the parties agree that the amount in controversy does not exceed $75,000, they may instead file a binding stipulation on or before May 15, 2026 that Plaintiff will not accept more than $75,000 in damages; if the parties so stipulate, the court will conclude it lacks diversity subject-matter jurisdiction and remand the case to Connecticut Superior Court. April 9, 2026 Filing 12 Notice to Counsel and Litigants Regarding AI-Assisted Research: Attorneys and pro se litigants alike should exercise great caution in submitting any AI-generated language in filings before the Court. Use of AI without verification of the accuracy of the information it generates like any other shoddy research method from other sources or tools implicates Federal Rule of Civil Procedure 11, the central purpose of which is to deter baseless filings in district court and thus to streamline the administration and procedure of the federal courts. Rule 11 applies fully to actions filed by pro se litigants.Therefore, all parties are on notice that the Court has a no-tolerance policy for any briefing (AI-assisted or not) that hallucinates legal propositions or otherwise severely misstates the law. Such filings will often result in sanctions absent reasonable excuse. See generally Willis v. U.S. Bank Nat'l Ass'n et al, No. 3:25-CV-516-BN, 2025 WL 1408897 (N.D. Tex. May 15, 2025).
