Date Filed Document Text
July 1, 2026 Filing 17 AO 121 Report on the Determination of an Action re: Copyright Form Completed (si)
June 8, 2026 Opinion or Order Filing 16 ORDER Dismissing Case With Prejudice. Plaintiff filed a notice of voluntary dismissal. ECF No. 15. Pursuant to Rule 41 of the Federal Rules of Civil Procedure, a notice of voluntary dismissal "automatically terminates the lawsuit," see Thorp v. Scarne, 599 F.2d 1169, 1177 n.1 (2d Cir. 1979), ifas was the case here, see ECF No. 15the notice is filed before "the opposing party serves either an answer or a motion for summary judgment." See Fed. R. Civ. P. 41(a)(1)(A)(i). When timely filed, "[n]o action by the court is necessary to effectuate the [notice of voluntary] dismissal." Thorp, 599 F.2d at 1171 n.1; see also Lindquist v. Murphy, No. 3:15-CV-0870 (CSH), 2015 WL 6692244, at *2 (D. Conn. Nov. 3, 2015) (recognizing that "because a voluntary dismissal is effective upon filing, no court order is technically required"). As a practical matter, however, the court routinely issues an order after a plaintiff files their voluntary dismissal notice to, inter alia, acknowledge receipt of the notice and the plaintiff's "state[d]" intentions as to prejudice, see Fed. R. Civ. P 41(a)(1)(B), find as moot any pending motions, and or issue directions to the Clerk of Court. Here, this action is dismissed with prejudice because Plaintiff so stated that intention in her notice. ECF No. 15. Furthermore, no pending motions remain, and the court thanks the Clerk's Office for already terminating this case. It is so ordered. Signed by Judge Omar A. Williams on 6/8/2026. (KM)

May 8, 2026 Filing 8 Notice to Counsel and Litigants Regarding AI-Assisted Research: Attorneys and pro se litigants alike should exercise great caution in submitting any AI-generated language in filings before the Court. Use of AI without verification of the accuracy of the information it generates like any other shoddy research method from other sources or tools implicates Federal Rule of Civil Procedure 11, the central purpose of which is to deter baseless filings in district court and thus to streamline the administration and procedure of the federal courts. Rule 11 applies fully to actions filed by pro se litigants. Therefore, all parties are on notice that the Court has a no-tolerance policy for any briefing (AI-assisted or not) that hallucinates legal propositions or otherwise severely misstates the law. Such filings will often result in sanctions absent reasonable excuse. See generally Willis v. U.S. Bank Nat'l Ass'n et al, No. 3:25-CV-516-BN, 2025 WL 1408897 (N.D. Tex. May 15, 2025).
