| Filing 85 In advance of this afternoon's hearing on the debtor's emergency motion for interim approval of DIP financing, the Court thought it might be helpful to the parties to set forth its preliminary observations. In view of the statements in the motion to shorten that the debtor urgently required access to capital to meet its immediate cash needs, the Court determined that it was appropriate to shorten notice. The Court, however, harbors serious reservations about approving an insider transaction without appropriate notice to parties in interest. The debtor will be afforded an opportunity to demonstrate that its ability to operate as a going concern will be jeopardized if it is not permitted to borrow before the motion may be heard on normal notice. Without prejudice to the debtor's right to be heard on the issue, however, the Court is doubtful that it would be appropriate to approve a transaction that grants insider releases on such limited notice to parties in interest.
