October 2, 2020 Opinion or Order Filing 70 ORAL ORDER: On or before October 12, 2020, local and lead counsel (i.e., those attorneys that will be leading trial) for the parties shall meet and confer and file an amended joint claim construction chart that sets forth the terms that remain in dispute. The meet and confer shall focus on an attempt to reach agreement on any remaining disputed terms where possible and on an attempt to focus the dispute over the remaining terms. The claim chart shall also identify no more than ten terms to be argued at the Markman hearing. Argument and decision on the rest of the terms at the Markman stage is DENIED. In connection with the dispositive motion briefing, the parties may brief any terms identified in the amended joint claim construction chart that have not been addressed but that the parties contend still require construction. Accompanying the amended joint claim construction chart shall be a letter identifying by name each individual who participated in the meet and confer, when and how that meet and confer occurred and how long it lasted. It is further ordered that the Markman hearing scheduled for October 19, 2020 at 2:00 PM will be conducted via videoconference. Each side shall be allocated one hour and thirty minutes for its presentation (i.e., the total allocation of time for the hearing will be three hours). No later than 48 hours prior to the hearing, the parties shall send a joint email to Cailah_Garfinkel@ded.uscourts.gov containing (1) a videoconference link and/or instructions on how to join the conference; (2) a list of attendees for each side; and (3) a separate audio-only dial-in number. The videoconference must be sufficient to accommodate Judge Hall, the courtroom deputy, a law clerk, and the court reporter. Any slide presentations or demonstratives that the parties wish to use during the hearing shall be emailed to Cailah_Garfinkel@ded.uscourts.gov no later than 24 hours prior to the hearing. Once the dial-in information is received by the Court, members of the public may obtain it by contacting Chambers at Cailah_Garfinkel@ded.uscourts.gov. All participants (including any media and members of the public) are reminded that recording or broadcasting proceedings is STRICTLY PROHIBITED.
