May 13, 2022 Opinion or Order Filing 5 ORAL ORDER: The motion for a TRO (D.I. #3 ) is DENIED. Defendant filed suit first, in Nebraska. (D.I. #1 , 46). Whether that is a violation of any agreement is a decision to be made in the first instance by the Nebraska court. It is also not established that this court has jurisdiction. The Court notes that three of the four Plaintiffs are LLCs. Their citizenship depends on the citizenship of their members. Thus, Plaintiffs are ordered to file a document listing all the members of each of the three LLC Plaintiffs, and, if any of the members are themselves LLCs, their members, etc.. As for the motion for a preliminary injunction, that will be considered after full briefing, which among other things, requires that Plaintiffs obtain a summons and serve Defendant.
