MEMORANDUM ORDER: Petitioner Rashaun Johnson's Request to Stay the Instant Proceeding (D.I. #1 at 5, 13) is DENIED. Petitioner's Petition for Writ of Habeas Corpus filed pursuant to 28 U.S.C. 2254 (D.I. #1 ) is DISMISSED WITHOUT PREJUDICE to provide Petitioner with an opportunity to exhaust state remedies. The Court also declines to issue a certificate of appealability because Petitioner has failed to make a "substantial showing of the denial of a constitutional right." 28 U.S.C. 2253(c)(2); 3d Cir.
