ORAL ORDER DENYING D.I. #28 Stipulation to Stay Entry of Scheduling order. The proposed stipulation is in effect a motion to stay the proceedings and to postpone entry of a scheduling order until the District Judge rules on the Objection to the Report and Recommendation (D.I.25 ) and is therefore DENIED. A pending motion (D.I. 7) does not operate as a stay of the litigation absent well-founded reasons for staying the case as set forth in a formal motion to stay. Whether this case proceeds here or in state court, it will proceed. Any discovery or motions practice that occurs in this case while objections are pending will be equally applicable to the case if it is ultimately remanded. Accordingly, the parties will suffer no prejudice from proceeding with the case.
