ORAL ORDER: Having reviewed Defendants' motion to dismiss and the accompanying briefing (D.I. #17 , #18 , #23 , #24 , #26 , #27 ), IT IS ORDERED that the motion to dismiss for failure to state a claim is DENIED. The Court has reviewed the Complaint and concludes that it plausibly alleges a claim for patent infringement, including a sale or offer for sale; the Complaint likewise plausibly alleges a claim for indirect patent infringement and willful infringement. Defendants Avdel UK Ltd.'s and Avdel Holding Limited's motion to dismiss for lack of jurisdiction over the person is DENIED with leave to renew following jurisdictional discovery. IT IS FURTHER ORDERED that, as explained during the April 6, 2026 status conference, Plaintiff's request for jurisdictional discovery (D.I. #23 at 16) is GRANTED. Jurisdictional recovery shall be limited to Avdel UK Ltd.'s and Avdel Holding Limited's contacts with Delaware involving the accused product (the Avdel Avbolt ECO) and shall be completed by May 26, 2026. Any renewed motion to dismiss for lack of personal jurisdiction must be filed by June 9, 2026 and shall use the Court's procedures set forth in paragraph 8(g) of this Court's form Scheduling Order - Patent. IT IS FURTHER ORDERED that the parties shall file a revised Scheduling Order on or before April 13, 2026.
