February 25, 2026 Opinion or Order TEXT ORDER terminating #4 Motion to Dismiss for Failure to State a Claim; granting #12 Motion to Change Venue: The Plaintiff, Alexandra Amparo, proceeding pro se, has moved for a transfer of this case to the venue of the District of Delaware where, according to the Complaint (ECF No. 1) as well as the Defendant's Motion to Dismiss ("MTD") (ECF No. 4), the Defendant is incorporated. The desire to transfer appears to be in response to the assertion in the MTD that this Court lacks personal jurisdiction over the Defendant. While the Defendant has expressed in its MTD a preference for a transfer to California where its principal place of business is located, a Plaintiff ordinarily has the choice of venue and there is a presumption that a Plaintiff's choice should be honored. Coady v. Ashcraft & Gerel, 223 F.3d 1, 11 (1st Cir. 2000). Whether the Court grants the change of venue to a district where the action could have been brought for the convenience of the parties, 28 U.S.C. 1404(a), or whether it transfers because it finds Rhode Island an improper venue, 28 U.S.C. 1406(a), the result is the same: this matter is transferred to the United States District Court for the District of Delaware. This transfer is ordered without deciding the issue of personal jurisdiction over Meta Platforms or the failure to state a claim upon which relief can be granted; therefore, the Motion to Dismiss for lack of personal jurisdiction (ECF No. 4) is neither granted nor denied. For administrative convenience, the Court directs the Clerk's Office to terminate that Motion, to be refiled in the District of Delaware if the movant deems appropriate.
