ORAL ORDER: The Court has reviewed the parties' letters regarding Defendants' request to extend the preliminary injunction briefing schedule (D.I. 63, D.I. 64, D.I. 65, D.I. 66). Defendants seek an extension allegedly because of hurdles in discovery, which have posed issues for both parties (see D.I. 64 (discussing Defendants' delay in producing product samples)), as well as the amount of material included in the exhibits to Plaintiffs' Motion for Preliminary Injunction (D.I. 31). Defendants also point to the parties' discovery disputes (D.I. 27, D.I. 46). The Court has resolved the parties' discovery disputes by requiring limited additional document production in response to the two discovery requests at issue. (See D.I. 71). However, under the circumstances, those disputes and the additional document production to be completed by Plaintiffs by no later than May 29, 2026 do not warrant the significant alteration of the parties stipulated briefing schedule (D.I. 15) that Defendants desire. Accordingly, IT IS HEREBY ORDERED that Defendants' request to extend the preliminary injunction briefing schedule is GRANTED-IN-PART and DENIED-IN-PART. Specifically, the deadline in D.I. 15 for Defendants to file their response brief on non-infringement, invalidity, and/or unenforceability, and otherwise responding to Plaintiff's opening brief is extended to June 8, 2026.
