ORDER granting in part and denying in part 35 Defendant's Emergency Motion to Compel Mental Examination of Plaintiff. The Court will allow the IME but not for the dates that Defendant requests.The mental examination shall be conducted by Dr. Eric M. Kaplan, M.D., at a date reasonable for both parties, on or before July 9, 2010. Plaintiff shall attend the examination unaccompanied by any observers. The examination shall take place at a location specified by Dr. Kaplan near Plaintiff� 39;s home in Ft. Myers, Florida, at a time that is reasonable for both Plaintiff and Dr. Kaplan. The total time required of Plaintiff shall not exceed 5 hours, absent good cause shown.The parties shall disclose their expert reports on or before July 16, 2010.Defendant's request for attorneys' fees and costs associated with the filing of this Motion is DENIED.
