The re: 38 Amended petition for writ of habeas corpus is denied. Grounds One, Two, and Four are denied with prejudice. Ground Three and all sub-claims related thereto are dismissed as procedurally defaulted. Ground Five is dismissed as time-barred. The Clerk of Court shall terminate any pending motions, enter judgment accordingly, and close this case.
