Count I is dismissed with prejudice to the extent that count contain s a procedural due process claim. Otherwise, Counts I, II, and III are each dismissed without prejudice. If Plaintiff intends to file a Second Amended Complaint, he must do so on or before April 28, 2017. All previously set case management deadlines in this case, including the trial, are held in abeyance.
