Date Filed Document Text
November 8, 2019 Opinion or Order Filing 14 ENDORSED ORDER. Before the Court is Plaintiffs' Notice of Settlement (Doc. #13) filed on November 8, 2019. As the parties have settled this suit, the Court will administratively close the file and dismiss the case without prejudice. See M.D. Fla. R. 3.08(b). Accordingly, it is ORDERED this case is DISMISSED without prejudice subject to the right of any party, within sixty (60) days from the date of this Order, January 7, 2020, to submit a stipulated form of final judgment or request an extension of time to do so, or for any party to move to reopen the case upon a showing of good cause. See M.D. Fla. R. 3.08(b). Once the sixty-day period expires, this dismissal shall be deemed with prejudice without further order. The Clerk is DIRECTED to terminate any scheduled deadlines and pending motions, and administratively close the case. Signed by Judge Sheri Polster Chappell on 11/8/2019. (KRH)

November 7, 2019 Opinion or Order Filing 12 ENDORSED ORDER. On November 6, 2019, the Court ordered Plaintiffs to show cause why this case should not be dismissed for failure to prosecute. (Doc. 10). Based on Plaintiffs' filing a motion for clerk's default (Doc. #11), the Court finds that they are actively prosecuting this case against Defendant. The Court thus will take no further action on its Order (Doc. 10). Signed by Judge Sheri Polster Chappell on 11/7/2019. (KRH)
November 6, 2019 Filing 11 MOTION for entry of clerk's default against Eastpoint Recovery Group, Inc. by Michael Ferrer, Christina Ferrer. (Attachments: #1 Affidavit, #2 Proposed Order)(Hormozdi, Shireen) Motions referred to Magistrate Judge Nicholas P. Mizell.
November 6, 2019 Opinion or Order Filing 10 ENDORSED ORDER. Plaintiffs filed this action on October 9, 2019. (Doc. #1). Plaintiffs filed a Return of Service, stating Defendant was served on October 14, 2019. (Doc. #5). Defendant has neither filed an answer nor defended against this action, and the time to do so has expired. But Defendant's failure to respond to the Complaint has not prompted Plaintiffs to move for clerk's default. Plaintiffs thus have shown a lack of interest in prosecuting this case. See Local Rule 3.10. Accordingly, the Court ORDERS Plaintiffs to show cause, in writing, on or before November 11, 2019, why this case should not be dismissed for failure to prosecute. Failure to comply with this Order will result in the dismissal of this action without further notice. Signed by Judge Sheri Polster Chappell on 11/6/2019. (KRH)
