If Plaintiff wishes to prosecute this action, he must initiate a new action by filing a new complaint. He should not use this case number on his complaint form. Because Plaintiff is not a prisoner and has been duly advised of Local Rule 1.03(e), should he initiate any future actions in this Court he must accompany the filing of his complaint with the requisite $400 filing fee or an application to proceed in forma pauperis appending a six-month statement of his FCCC resident account. The failure to pay the filing fee or submit an application to proceed in forma pauperis at the time he files a future complaint will result in a sua sponte dismissal of the complaint.
