TEXT ORDER. Plaintiff filed a complaint for limitation of liability (Doc #1). But the complaint contradicts itself by alleging the incident occurred on the navigable waters near Bonita Bay while also claiming it occurred off the waters of Naples, Florida. (Compare Doc. 1 at 1, 2 para. 7, with Doc. 1 para. 12; Doc. 4-1). Further, the declaration of Michael Hunter (Doc. [1-1]) asserts the post-incident value of the vessel is $50,828, but the letter of undertaking from Geico (Doc. [4-1]) guarantees payment not to exceed $50,528--$300 less than the vessel's purported value.
