TEXT ORDER. Defendant is DIRECTED to file a response to the #4 Motion for Preliminary Injunction no later than October 23, 2023. Defendant's response shall be no longer than 20 pages inclusive of all parts. Plaintiff may file a reply no later than October 26, 2023. Plaintiff's reply should include specific argument regarding this Court's jurisdiction. Plaintiff's reply shall be no longer than 15 pages inclusive of all parts. The Court cannot give a date certain for the hearing on the Motion for Preliminary Injunction at this time, but any hearing shall take place in the Tampa Division courthouse, with all attorneys present in court and with all witnesses testifying live in court. The parties should refer to the Court's "Instructions Regarding Exhibit Lists, Marking Exhibits, Sensitive Exhibits, and Electronic Exhibit Binders" and use the appropriate witness and exhibit lists, all available under the "Forms" tab at https://www.flmd.uscourts.gov/judges/john-badalamenti. The parties are DIRECTED to file any witness lists and exhibits lists on the docket no later than October 28, 2023. In the interest of judicial economy, the parties shall confer prior to the filing of such lists and, to the extent possible, the parties shall file joint exhibits. Separately, the Court requests that, on or before October 28, 2023, all documentary evidence that the parties intend to utilize at the hearing be emailed to chambers_flmd_badalamenti@flmd.uscourts.gov, pre-marked for identification. The Court would consider staying the deadlines set forth herein upon the parties' joint representation to the Court that they are engaging in good faith settlement negotiations.
