TEXT ORDER. The complaint and defendants' notice of removal indicate that diversity jurisdiction may be absent because the amount in controversy is unclear. The complaint alleges only the state-court jurisdictional amount for a single claim of defamation per se. And, other than citing plaintiff's general allegations in support of defamation, there is no evidence that defendants rely upon that proves the amount in controversy more likely than not exceeds $75,000. See Roe v. Michelin N. Am., Inc., 613 F.3d 1058, 1061 (11th Cir. 2010). Without more, the court is left to speculate whether subject-matter jurisdiction exits. See Maletta v. Woodle, 2:20-CV-1004-JES-KCD, 2023 WL 2495808, *1 (M.D. Fla. Mar. 14, 2023) (jury awarded $1 in damages for each person who signed defamatory letter, resulting in $138 in compensatory damages and $138 in punitive damages). By July 9, 2024, defendant must supplement its notice of removal regarding the amount in controversy. Failure to do so will result in remand without further notice.
