January 17, 2025 Opinion or Order Filing 11 ORDER DIRECTING WAIVER OF REQUEST FOR SERVICE. 1. The clerk shall send via certified mail to each defendant the following: (1) the complaint (Doc. 1); (2) a "Notice of Lawsuit and Request for Waiver of Service of Summons" form; (3) two "Waiver of Service of Summons" forms; and (4) this order. The clerk shall fill in the date of mailing in the notice and send each defendant a stamped, preaddressed envelope to return the waiver to the court. All costs of mailing shall be advanced by the United States. The clerk shall file copies of the notices, so the docket reflects the addresses and the dates of mailing. 2. The defendants have 30 days from the date the waiver forms are mailed to return them in the preaddress envelopes. 3. A defendant who waives service shall have 60 days from the date the clerk mailed the waiver forms to answer or otherwise respond to the complaint. 4. If a defendant does not return a signed waiver within 30 days from the date it was mailed, the United States Marshal will be directed to personally serve that defendant, and the court will assess that defendant the costs of personal service as set forth in the Federal Rules of Civil Procedure.
