TEXT ORDER. Defendant Danesh Noshirvan failed to appear for an in-person Rule 16 conference scheduled on July 17, 2017. Yet, he never requested a continuance, nor did he contact the court. In addition, Noshirvan failed to engage in a planning conference and file a case management report in violation of our local rules and orders. See M.D. Fla. R. 3.02; Civil Action Order, Doc. #3 at 3. The Civil Action Order also directs the parties to meet and confer about selecting a mediator when filing a CMR, but Noshirvan ignored that directive as well. As such, by August 1, 2025, Noshirvan must show cause why he should not be sanctioned or held in default for failing to appear or otherwise defend. While noting that Luthmann remained free to file an amended complaint as of right, the order denied him leave to file the amended complaint in its then-existing form because it did not comport with our CM/ECF filing requirements. But as Luthmann correctly asserts, neither party in this action is filing items via CM/ECF because they are not represented by counsel. Therefore, the July 10 order (Doc. 31) is VACATED. We will discuss the pleading standards during the in-person Rule 16 conference on July 17, and Luthmann will be afforded additional time after that conference to file his amended complaint. ENDORSED ORDER granting in part #33 plaintiff Luthmann's construed motion for clarification of the Civil Action Order. The Civil Action Order (Doc. #3), which is docketed in every civil case opened in this division, generally provides that the parties and their counsel must comply with the federal and local rules, the district's discovery and electronic-filing guidelines, and the professionalism expectations and guidelines promulgated by the Florida Bar. While Luthmann has repeatedly argued that his opponent, Noshirvan, should have to comply with the professionalism standards (see, e.g., Doc. #9 at 1-2; Doc. #19 at 4), he has since had a change of heart. He now argues that neither he nor Noshirvan should be held to these standards because they are not lawyers (Luthmann used to be a lawyer, but that was before this action was initiated). Fair point. But while Luthmann's filings in this case have criticized others for being "hyper literal," he is guilty of that here. Arguably, the portion of the Civil Action Order at issue could be more precise, but it is not reasonable to construe it as requiring non-lawyers to abide by standards for lawyers, and that is neither its import nor intent. The order does not make the pro se parties in this action subject to the various rules of professionalism that govern the conduct of lawyers. Signed by Magistrate Judge Nicholas P.
