July 21, 2026 Opinion or Order Filing 24 TEXT ORDER. This action has been plagued by unprofessional failings from the start. Despite our calls for rectitude (Docs. 6, 13, 18, 21, 22), the litigators fail to toe the line. In the latest episode, they were directed--for at least the fourth time--to name their mediator by July 20 or show cause why they should not be sanctioned for noncompliance. (Doc. 22). They chose to do neither. Moreover, defense counsel has yet to file the Local Rule 3.03 disclosure for his client despite our February 4 order requiring its immediate filing upon a first appearance (the defendant first appeared more than three months ago), despite our June 26 order generously granting an extension until July 13, and despite Plaintiff's compliance with that extended deadline (Doc. 23). By July 27, defense counsel must properly file the Local Rule 3.03 disclosure form for his client, or we will direct the United States to replace him with substitute counsel. By July 27, the parties must also file their joint notice of selection of mediator, or this case may be dismissed without further notice, and defense counsel may be assessed a financial penalty of up to $250. To improve the litigators' practices going forward and otherwise in the interests of justice, by July 29, plaintiff and defense counsel must each file a notice of compliance certifying that--after the entry of this order--they have read The Florida Bar Creed of Professionalism, The Florida Bar Professionalism Expectations (2026 edition), and The Florida Bar Trial Lawyers Section's Guidelines for Professional Conduct (2024 edition).
