August 18, 2026 Opinion or Order Filing 28 ENDORSED ORDER denying without prejudice for failure to comply with Local Rule 3.01(g) #26 Defendants' motion to compel and #27 Plaintiff's motion for extension of time. Defendants' conferral efforts involve nothing more than three emails exchanged between the parties on August 17, 2026. (Doc. 26-3). But as stated in the civil action order: "For anything other than joint or unopposed motions, the term 'confer' requires a substantive conversation in person, by telephone, or via videoconference. It does not envision an exchange of ultimatums by email or letter." (Doc. #11 at 5-7). So, the motion complies with neither Local Rule 3.01(g) nor the civil action order. And Plaintiff's motion for extension of time is also denied without prejudice for failure to comply with Local Rule 3.01(g) as it fails to state the conferral method. See Local Rule 3.01(g)(2)(C). It appears that Plaintiff conferred with Defendants via the email exchange in Doc. 26-3. If so, this conferral is improper for the reasons stated above. Signed by Magistrate Judge Nicholas P.
