Filing 47
ENDORSED ORDER. The Court has under advisement #36 Plaintiff's Motion for Order to Show Cause and to Hold Defendants in Civil Contempt of Court for Violations of TRO, for Coercive Sanctions, and for an Award of Attorneys' Fees and Costs. Defendants had until September 28, 2026, to respond, but they failed to do so. Local Rule 3.01(d) warns that "[i]f a party fails to timely respond, the motion is subject to treatment as unopposed." Thus, the Court treats the motion as unopposed. Nevertheless, for purposes of judicial economy, the Court will give the parties time to resolve the issues raised in the motion without further judicial intervention. Accordingly, by October 13, 2026, the parties are DIRECTED to file a joint status report explaining whether they have resolved all or some of the issues in the motion. The parties must include an explanation of any actions they believe are necessary to lead to prompt resolution of the motion. Upon receipt of the status report, the Court will determine how to further proceed. Signed by Judge Sheri Polster Chappell on 9/29/2026. (SEJ)

Filing 38
ENDORSED ORDER. On September 2, 2026, at 3:45 p.m., the Court entered a temporary restraining order ("TRO") against Defendants. (Doc. 7). Federal Rule of Civil Procedure 65(b)(2) provides that the TRO "expires at the time after entry--not to exceed 14 days--that the court sets, unless before that time the court, for good cause, extends it for a like period or the adverse party consents to a longer extension. The reasons for an extension must be entered in the record." Defendants have not consented to an extension. Nevertheless, for the following reasons, the Court finds good cause to extend the TRO. The Court conducted a day-long evidentiary hearing in connection with the preliminary injunction motion on September 14, 2026 (Doc. 37) and requires the additional time to rule on that portion of Plaintiff's motion that requested a preliminary injunction. Both parties introduced voluminous evidence, presented oral argument, and submitted briefs on the matter. The Court is diligently working to promptly rule on the motion but requires additional time to do so. Accordingly, the Court extends the TRO through September 30, 2026, at 3:45 p.m. Signed by Judge Sheri Polster Chappell on 9/16/2026. (SEJ)

Filing 29
ENDORSED ORDER. On September 3, 2026, the Court issued an Order explaining the procedures for its preliminary injunction hearing. (Doc. 9). The Order directed the parties to file electronic exhibit binders and included detailed instructions. Neither party complied with this Order. Additionally, there is the matter of Defendants' response, titled: Defendants' Corrected Response In Opposition to Plaintiff's Motion for Preliminary Injunction and Motion to Dissolve Or Modify Temporary Restraining Order. (Doc. 24). This request for relief is not permitted. See Fed. R. Civ. P. 7(b) ("A request for a court order must be made by motion."); Ramirez v. General Motors, LLC, No. 8:24-CV-2468-TPB-AEP, 2026 WL 201225, at *2 n.1 (M.D. Fla. Jan. 27, 2026) (noting "[i]t is not proper to combine a response in opposition with a motion seeking affirmative relief"); Armington v. Dolgencorp, Inc., No. 3:07-CV-1130-J-JRK, 2009 WL 210723, at *2 (M.D. Fla. Jan. 20, 2009) ("It is not appropriate to seek an order for affirmative relief in a response to a motion."). This case is in its infancy, yet the Court has had to remind Plaintiff to file a proposed TRO (Doc. 5), strike Defendants' response brief (Doc. 21), explain the law against filing a motion within a response to Defendants (above), and now must direct both parties to file electronic exhibit binders for the second time. This is unacceptable. The parties are DIRECTED to file their electronic exhibit binders by September 11, 2026, at 4:00 p.m. Additionally, the parties are DIRECTED to SHOW CAUSE no later than September 11, 2026, at 4:00 p.m. why they should not be sanctioned for their repeated failure to follow this Court's rules and orders. Signed by Judge Sheri Polster Chappell on 9/11/2026. (SEJ)

Filing 21
ENDORSED ORDER striking #19 Defendants' response to Plaintiff's Emergency Motion for Preliminary Injunction and Ex Parte TRO. (Doc. 19). The exhibits attached to the motion comprise a 121-page pdf. (Doc. 19-1). The Civil Action Order mandates that "[d]ocuments that accompany a paper must be filed as separate PDF files, and each must be given a concise, unique, and objective label using the category and description fields provided by the CM/ECF system[.]" (Doc. 4). The Civil Action Order clearly states that the "court may strike filings that fail to heed this directive." Accordingly, the response is STRICKEN. The Clerk is DIRECTED to strike the response from the docket. If Defendants file anything else in this case, they must attach exhibits individually to the motion and label them so the Court may easily find them in the record. Defendants are DIRECTED to contact the Clerk's office with any questions about filing exhibits. Failure to properly file a motion and exhibits will result in the Court striking future filings without further notice. Signed by Judge Sheri Polster Chappell on 9/10/2026. (SEJ)
