PAPERLESS ORDER denying, without prejudice, #14 Motion to Appoint Counsel ; granting in part and denying in part #14 Motion for Extension of Time to Amend. Plaintiff's motion to appoint counsel is denied without prejudice for the reasons in ECF No. 7. Plaintiff's motion for extension of time to file an amended complaint is granted in part and denied in part. Plaintiff contends that he needs more time to file an amended complaint because of a quarantine at his prison. However, the court mailed him the 1983 form complaint, ECF No. 5-1, with its order to amend, ECF No. 5, and the form requires only fact pleading. Thus, there is no per se need to access the law library or an inmate law clerk to file an amended complaint. Nonetheless, because of the quarantine and the modestly irregular procedural history of the case, the court grants plaintiff a partial extension from the current deadline of June 22, 2020 to July 6, 2020 to file a proper amended complaint in accordance with the order to amend. All provisions of the order to amend shall otherwise remain in full force and effect. This means, among other things, that the amended complaint must be received by the court and docketed by the new deadline of July 6, 2020, and that the court will NOT use the date on which plaintiff signs the amended complaint or the date on which he submits it to prison authorities for mailing as the date of filing. Plaintiff is hereby cautioned that the failure to timely file a proper amended complaint SHALL RESULT IN DISMISSAL OF THE CASE. Signed by Magistrate Judge Lisette M. Reid on 6/16/2020.
