Plaintiff and Defendant FMA Alliance Ltd. previously filed a stipulation to dismiss with prejudice #57. Plaintiff and Defendant First National Collection Bureau, Inc. have filed a stipulation of dismissal as well #66. Accordingly, the claims against First National Collection Bureau, Inc. are dismissed with prejudice. Thus, the only claims remaining are Plaintiff's claims against Defendant Diversified Consultant, Inc ("DCI"). Those claims, however, have been stayed because DCI filed for Chapter 7 bankruptcy in the Middle District of Florida. See #37. Because DCI is the only remaining defendant, the Court sua sponte transfers this case to the Middle District of Florida. The Court finds that transfer is warranted under 28 USC 1404(a). More specifically, the convenience of the parties factor for transfer weighs in favor of transfer because DCI and Plaintiff are the only remaining and Plaintiff has already filed an unsecured claim in DCI's bankruptcy case in the Middle District of Florida. See In re: Diversified Consultants, Inc., Case No. 3:20-bk-01311-JAF, Official Claims Register, Claim No. 54 (Bankr. M.D. Fla. Nov. 13, 2020). The Court further finds that the convenience of the witness factor is neutral as both Plaintiff and DCI would have an interest in keeping the case in Illinois and Florida respectively. Lastly, the Court finds that the interest of justice factor weighs heavily in favor of transfer. DCI is currently proceeding in a Chapter 7 bankruptcy and Plaintiff has filed an unsecured claim in that proceeding. The risk of courts issue conflicting rulings is high if this case remains in this district. The Court places significant weight on this factor. Finally, Plaintiff's request that FNCB amend its response to Plaintiff's Interrogatory No. 11 and the corollary RFP No. 19 is denied in large part except FNCB shall amend its answer to Interrogatory No. 11 along the lines stated on last page of the parties' Joint Status Report #56 to the effect that FNCB obtained Plaintiff's telephone number from a skip trace via Experion, and FNCB shall produce in response to RFP No. 19 any documentation in its possession, custody, or control that supports that amended response. FNCB can redact from any documents so produced information that identifies the consumer or creditor and any other information that is not needed to support the amended interrogatory response to the effect that FNCB obtained Plaintiff's telephone number via an Experion skip trace. If either party wants to serve additional written discovery, they shall do so by 12/10/21. The Court construes that Status Report as a joint motion to resolve the discovery disputes concerning certain of Plaintiff's interrogatories and requests for production ("RFPs") to Defendant FNCB that are outlined in the Report #56. The joint motion is set for a telephonic hearing on 11/23/21 at 11:00 a.m. The parties are advised that the Court is at present inclined to deny Plaintiff's request that Defendant FNCB be compelled to produce more information about its dialing and text messaging systems, as outlined at pages 1-2 of the Status Report #56, and to deny Plaintiff's request that Defendant FNCB produce more documents in response to Plaintiff's RFP 5.
