February 24, 2026 Opinion or Order Filing 2 ENDORSED ORDER. Petitioner, Roosevelt Charles Booth, an inmate of the Florida penal system, filed a pro se #1 document titled, "Petition for Writ of Mandamus," in which he challenges a decision by the Circuit Court of the Eighth Judicial Circuit in and for Union County, Florida, transferring his state habeas corpus action to Manatee County, Florida. To the extent Petitioner seeks relief from this Court, he has not properly commenced a civil action. See Fed. R. Civ. P. 3 ("A civil action is commenced by filing a complaint with the court."); see also M.D. Fla. R. 6.04(a) ("A pro se person in custody must use the standard form[.]"). Moreover, 28 U.S.C. 1361 provides that a federal court may issue a mandamus order "to compel an officer or employee of the United States or any agency thereof to perform a duty owed to the [movant]." Petitioner appears to seek an order directing state officers to exercise ministerial duties. Indeed, he styles the pleading as one for filing in Florida's First District Court of Appeal. To the extent Petitioner intends to file a federal habeas petition challenging his Manatee County conviction, the proper court in which to initiate such an action is the Tampa Division of the Middle District, but Petitioner first must exhaust his state court remedies.
