April 20, 2026 Opinion or Order Filing 3 ENDORSED ORDER. Marbin Rene Rodriguez Torres, an immigration detainee, filed a petition for writ of habeas corpus pursuant to 28 U.S.C. 2241. (Doc. #1). However, Petitioner did not personally sign the petition. An "[a]pplication for a writ of habeas corpus shall be in writing signed and verified by the person for whose relief it is intended or by someone acting in his behalf." 28 U.S.C. 2242. Additionally, Federal Rule of Civil Procedure 11(a) provides, "Every pleading, written motion, and other paper must be signed by... a party personally if the party is unrepresented." The "signature" on the petition is typed and the mailing envelope reflects the documents were mailed from another individual in Utah. (See Doc. #1 at 10; Doc. [1-1] at 1). Because Petitioner did not personally sign the petition, the petition (Doc. #1) is DISMISSED without prejudice, and the Clerk shall terminate any pending motions and close the file. The Clerk shall also send Petitioner a blank petition for writ of habeas corpus form for use in 2241 cases and an application to proceed in forma pauperis (prisoner filings) form.
