In responding to question number 2, defendant states, in part, that "Defendant, Cracker Barrel Old Country Store, Inc., a Foreign Profit Corporation, is a citizen of the State of Tennessee." Id. at 2. Defendant's response fails to comply with 28 U.S.C. 1332(c)(1). Under 28 U.S.C. 1332(c)(1), "a corporation shall be deemed to be a citizen of every State and foreign State by which it has been incorporated and of the State or foreign state where it has its principal place of business." Moreover, the disclosure statement form changed effected November 1, 2025, and is found on the court's website, www.flmd.uscourts.gov. Defendant is directed to file a disclosure statement using the appropriate form on or before April 30, 2026. The Clerk of Court is directed to remove doc. 9 from the official court record.
