TEXT ORDER. Plaintiff's #1 Complaint brings claims against defendants for events that occurred in Jacksonville, Florida, and alleges that a majority of the defendants also reside in Jacksonville, Florida. As to Defendant Teresa Shamas, Plaintiff's original #1 Complaint did not state where she resides, but his putative Amended Complaint (Doc. #8) adds that she resides in Florida without specifying which county or city. Accordingly, the Court directed Plaintiff to show cause as to why this action should not be transferred to the Jacksonville Division of the Middle District of Florida. (Doc. 6). Plaintiff responded that his probation limits his travel and that this action includes defendants that live in St. Augustine, Florida. (Doc. #11). The Jacksonville Division encompasses Duval County, Florida, where both St. Augustine and Jacksonville are located. M.D. Fla. Loc. R. 1.04(a). Moreover, Local Rule 1.04(b) provides that "[a] party must begin an action in the division to which the action is most directly connected or in which the action is most conveniently advanced. Unless otherwise administratively ordered by the chief judge, the judge must transfer the action to the division most consistent with the purpose of this rule." Pursuant to Local Rule 1.04(b), this case is transferred to the United States District Court for the Middle District of Florida, Jacksonville Division. ZDANOWICZ, Defendants, No. 6:25-CV-1673-PGB-NWH, 2025 WL 4692958, at *1 (M.D. Fla. Sept. 11, 2025) (transferring the action to the division where the underlying events occurred and the defendant resided); Page v. Univ. of Cent. Fla. Bd. of Trs., No. 5:25-CV-742-PRL, 2026 WL 828930, at *3 (M.D. Fla. Mar. 26, 2026) (transferring the action to the division where "most of the events giving rise to the lawsuit occurred" and where most of the defendants resided). Accordingly, the Clerk of Court is DIRECTED to transfer this action and forward the file to the Jacksonville Division, deny any pending motions as moot, terminate any deadlines, and close the Tampa Division file. TEXT ORDER. Plaintiff brings his Complaint in the Tampa Division of the United States District Court for the Middle District of Florida. (See Doc. #1). 28 U.S.C. 1391 provides that "[a] civil action may be brought in... a judicial district in which any defendant resides, if all defendants are residents of the State in which the district is located" or "a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of property that is the subject of the action is situated." However, the Complaint brings claims against defendants for events that occurred in Jacksonville, Florida. (Id.). Indeed, the Complaint alleges that almost all of the Defendants are in Jacksonville, Florida. (Id. at 2). Plaintiff includes his spouse, Teresa Shamas, as a defendant, but fails to state where she resides. (Id.). Accordingly, Plaintiff is DIRECTED to SHOW CAUSE on or before May 26, 2026, as to why the Tampa Division rather than the Jacksonville Division is the proper venue for this matter.
