On or before APRIL 3, 2020, the Movant shall file a notice with the Court, in which Movant either (a) agrees to the recharacterization of the motion as a 2255 motion, or (b) withdraws the motion, rather than have the Court recharacterize it as a 2255 motion., ( Amended Complaint due by 4/3/2020.) March 4, 2020 Opinion or Order Filing 6 PAPERLESS STRIKING/VACATINGORDER re 5 Order. It appears that a revocation of probation judgment was entered in 2018. Given the state of the underlying criminal record, it is unclear whether Movant is seeking to challenge, for the first time, his revocation judgment; or, whether he is seeking to challenge the execution of his sentence, following the revocation judgment. In any event, it does not appear that he has filed a 2255 motion after the revocation judgment was entered. Any such filing, attacking the revocation judgment would not be successive. Therefore, the court's prior order shall be re-entered, and Movant given the appropriate instructions regarding the filing of this "letter" proceeding. Signed by Magistrate Judge Lisette M. Reid on 3/4/2020. (nn) [Transferred from flsd on 6/9/2020.]
March 4, 2020 Opinion or Order Filing 5 "VACATED/STRICKEN" PAPERLESS ORDER vacating re #4 Order,,, Set/Reset Deadlines. Upon more careful review of this filing, together with the court's electronic docket, it appears that this latest filing is, in fact, a successive petition. Movant has filed two prior 2255 motions with this court, Nos. 17cv23098 and 18cv20547. To the extent this is challenging the execution of his sentence, it is more properly filed by way of a habeas petition pursuant to 28 U.S.C. Section 2241. Signed by Magistrate Judge Lisette M. Reid on 3/4/2020. (nn) Modified on 3/5/2020 (ls). (Vacating/Striking per DE #6) [Transferred from flsd on 6/9/2020.]

Signed by Magistrate Judge Lisette M. Reid on 3/3/2020. See attached document for full details. (Attachments: #1 2255 Complaint Form) (fbn) Modified on 3/5/2020 (ls).
