Filing 14
ENDORSED ORDER denying #11 construed Motion for Reconsideration / Clarification re #11 MOTION for Reconsideration re #6 Order filed by Larry Dancy. No proper grounds for reconsidering Dkt. 6 are set forth here. Dkt. 6 dismissed this Bivens suit as it is duplicative of a pending matter, found at 5:23-cv-558-CEM. It may be this Dkt. 11 here is an attempt to amend the dismissed the complaint to allege a Federal Tort Claims Act case against Coleman USP employees Pachuilla and Stephens. Dkt. 11 can be read that way. This attempt runs afoul of the same issue that caused the dismissal at Dkt. 6. The alleged assault of April 26, 2023 by these defendants is the subject of this earlier-filed suit. Mr. Dancy may not simultaneously litigate two separate suits from the same alleged incident. This file here is closed. Mr. Dancy may proceed in this presently-filed and pending, earlier law suit. Signed by Judge William F. Jung on 7/17/2024. (Jung, William)
