ENDORSED ORDER denying Plaintiff's motion for a preliminary injunction (Dkt. #21). The court cannot grant the request, as there is currently no operative complaint. (See Dkt. [7, 8]). Without an operative complaint, the court cannot gauge the likelihood that Plaintiff will succeed on the merits of his claims. See Schiavo ex rel. Schindler v. Schiavo, 403 F.3d 1223, 1225-26 (11th Cir. 2005) ("[I]njunctive relief may not be granted unless the plaintiff establishes the substantial likelihood of success criterion."). Although the time for Plaintiff to file an amended complaint has now passed, (see Dkts. #7, 8), the court will, given the serious nature of the allegations, grant Plaintiff thirty days to file a second amended complaint. Accordingly, on or before January 9, 2025, Plaintiff may file a second amended complaint that corrects the pleading deficiencies outlined in the court's order (Dkt. #7) dismissing his initial complaint and that complies fully with the Federal Rules of Civil Procedure and this court's Local Rules. If Plaintiff fails to do so by the deadline, this case will be dismissed. The clerk is DIRECTED to send Plaintiff a blank civil rights complaint form and a printout of the docket.
