Filing 84 ORDER granting in part and denying in part 68 motion to dismiss; denying 79 cross-motion for leave to dismiss. The Defendants' Motion to Dismiss (Doc. 68) is GRANTED IN PART and DENIED IN PART. Counts I, II, III, VI, and X are DISMISS ED in full. Because the Plaintiffs have indicated that they do not wish to pursue those claims, the Court declines to grant them the opportunity to replead them. The LLC Entities are DISMISSED from Count VIII.
