| Filing 14 Emergency MOTION to Stay Transfer by RAYON SHERWIN PAYNE. (Attachments: #1 Text of Proposed Order)(PAYNE, RAYON) [Transferred from dcd on 9/25/2025.] |
MINUTE ORDER denying #14 Motion to Stay. Plaintiff largely repeats the arguments that he made in his Opposition to the government's Motion to Transfer--none of which persuade this Court that a stay is warranted. The federal district courts in the Middle District of Florida are well-equipped to adjudicate this case. Signed by Judge Ana C. Reyes on 09/04/2025. (lcacr2) [Transferred from dcd on 9/25/2025.]

MINUTE ORDER granting #12 Motion to Transfer Case; denying #12 Motion to Dismiss. The Court TRANSFERS this case to the Middle District of Florida, where Plaintiff resides, pursuant to 28 U.S.C. 1404. The Court finds that this action could have been brought in Plaintiff's district, because that is where Plaintiff "resides" and "no real property is involved in the action." 28 U.S.C. 1391(e)(1). Private and public interests also support transfer. As to private interests, Plaintiff does not reside in the District of Columbia, and relevant events did not occur here. Wolfram Alpha LLC v. Cuccinelli, 490 F. Supp. 3d 324, 331-33 (D.D.C. 2020). And Plaintiff "cannot reasonably claim to be inconvenienced by litigating" in his "home forum." Id. at 333 (citation omitted). As to public interests, "[t]he interest in deciding local controversies at home is the public interest factor of most importance." Bourdon v. United States Dep't of Homeland Sec., 235 F. Supp. 3d 298, 308 (D.D.C. 2017). Here, Plaintiff will experience the impacts of any claimed injury in the district in which he resides. Lastly, another federal district court certainly possesses equivalent expertise in applying federal immigration law. In light of this Order, the Court does not address Defendant's Motion to Dismiss. The Court DIRECTS the Clerk of the Court to transfer this case to the Middle District of Florida. Transfer due by 9/24/2025. Signed by Judge Ana C. Reyes on 09/04/2025. (lcacr2) [Transferred from dcd on 9/25/2025.]
