In the motion, Defendant states that Plaintiff provided Exhibit 13 to defense counsel within the time allotted by the magistrate judge's order, (Dkt. #80, Dkt. #93 at 7), but forbade defense counsel from sharing the document with Defendant or anyone else by designating the exhibit as "Attorney Eyes Only," (Dkt. #96). Defendant argues that this restriction constitutes a failure to timely disclose the evidence, warranting its exclusion under Federal Rule of Civil Procedure 37 or a delay of the January 12, 2026 hearing. (See id. at 4, 11-12.) "District courts have unquestionable authority to control their own dockets. This authority includes broad discretion in deciding how best to manage the cases before them." Smith v. Psychiatric Sols., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (quotations and footnote omitted). Under Rule 37, courts have discretion to fashion remedies for discovery violations. See Adkins v. Christie, 488 F.3d 1324, 1331 (11th Cir. 2007) ("[D]istrict courts have broad discretion in fashioning discovery rulings[.]"). Here, Plaintiff timely provided Exhibit 13 to Defendant, (See Dkt. #80, Dkt. #93 at 7), which counsels against excluding the evidence under Rule 37. Further, to the extent that Defendant believes Plaintiff's limitations on the exhibit's use violated the spirit of the magistrate judge's order, the parties' dispute appears to be moot, as Plaintiff has since "agreed to use a revised [seven]-page exhibit," which is not subject to an "Attorney Eyes Only" designation. (See Dkt. #103 at 9.) Given that Defendant may review and discuss the exhibit with counsel before the hearing, the court declines to exercise its discretion to exclude the evidence or delay the January 12, 2026 hearing. To ensure that notice is not illusory, the adverse party must be allowed an opportunity to respond. Four Seasons Hotels & Resorts, B.V. v. Consorcio Barr, S.A., 320 F.3d 1205, 1210 (11th Cir. 2003) ("In order for a preliminary injunction to issue, the nonmoving party must have notice and an opportunity to present its opposition to the injunction."); All Care Nursing Serv., Inc. v. Bethesda Mem'l Hosp., Inc., 887 F.2d 1535, 1538 (11th Cir. 1989) ("[T]he notice required by Rule 65(a) before a preliminary injunction can issue implies a hearing in which the defendant is given a fair opportunity to oppose the application and to prepare for such opposition." (quoting Granny Goose Foods, Inc. v. Bhd. of Teamsters & Auto Truck Drivers, 415 U.S. 423, 432 n.7 (1974))). Although the court may exercise discretion when determining whether an adverse party has received sufficient notice, "the underlying principle of giving the [adverse party] notice and an adequate opportunity to respond is carefully honored by the courts." Id. (quotation omitted). In this case, the TRO is set to expire shortly, and Defendant has only just appeared. (Dkt. #13 at 16; Dkt. 19.) Further, Defendant has moved to extend several deadlines to December 8, 2025, including the deadline for him to respond to Plaintiff's motion to convert the TRO to a preliminary injunction. (Dkt. 19 at 2-3.) The court, therefore, finds good cause to extend the TRO period to December 10, 2025, which will preserve the status quo while Defendant fashions a response to Plaintiffs' application. See Fed. R. Civ. P. 65(b)(2) (authorizing courts to extend TROs for good cause); Jetchill Ltd. v. Shenzhen Jiarui Minghui Trading Co., No. 1:25-CV-23377-DSL, 2025 WL 2962075, at *3 (S.D. Fla. Oct. 13, 2025) ("A TRO may be extended for good cause where there is a pending motion for preliminary injunction to be heard." (quotation omitted)). The TRO previously entered in this case (Dkt. #13) is made a part of this order and EXTENDED through 6:22 PM EST on December 10, 2025.
