ENDORSED ORDER. The court is aware of Defendants' pending motion to dismiss. (See Dkt. #11.) Nonetheless, Defendants must fully comply with Local Rule 3.02. To the extent that Defendants are concerned about waiving their jurisdictional arguments, the court will not consider Defendants' participation in crafting a case management report to waive the defense. See Pouyeh v. Pub. Health Trust of Jackson Health Sys., 718 F. App'x 786, 792 (11th Cir. 2017) (concluding that the defendants did not waive their objections to the sufficiency of service of process when responding to a motion for preliminary injunction at the district court's direction because they "raised the defense in accordance with [Federal Rule of Civil Procedure] 12 and did not otherwise invoke the court's jurisdiction on a matter other than jurisdiction."); Hoffman v. Jimenez, No. 2:25-CV-131-JLB-KCD, 2025 WL 1727901, at *2 (M.D. Fla. June 13, 2025) (holding that the defendants did not waive their objections to the sufficiency of service of process by moving to dismiss the complaint on the merits); Montgomery Bank, N.A. v. Hoolihan, No. 2:16-CV-173-FTM-38CM, 2016 WL 1704202, at *2 (M.D. Fla. Apr. 28, 2016) ("[T]he [L]ocal [R]ules state [that] counsel and any unrepresented party shall meet, regardless of the pendency of any undecided motions, for the purpose of preparing and filing the [case management report]." (emphasis omitted)). Accordingly, the parties shall file a joint case management report by April 3, 2026.
