A mediator first reported that this case settled completely, (see Dkt. #35), and then corrected the report to indicate that the case settled solely as to Defendant Zhende Tech, (see Dkt. #36), which is the only Defendant that Plaintiff moved to preliminarily enjoin, (see Dkt. #23). After the court granted the motion for preliminary injunction, (see Dkt. #28), Zhende Tech appealed to the Federal Circuit, (see Dkt. #29). However, this case is no longer on appeal. (See Dkt. #37.) The case was stayed and administratively closed in this court pending the appeal. (See Dkt. 30.) In light of the above, on or before July 15, 2026, Plaintiff shall file a status report in this court. ENDORSED ORDER. The temporary restraining order (TRO) in this case (Dkt. #10) was entered at 6:15 P.M. E.D.T. on March 9, 2026, and stated that it "shall remain in effect for fourteen days from its time of entry." (Id. at 16-17.) Federal Rule of Civil Procedure 65 provides: "[An ex parte TRO] expires at the time after entry--not to exceed [fourteen] days--that the court sets, unless before that time the court, for good cause, extends it for a like period or the adverse party consents to a longer extension. The reasons for an extension must be entered in the record." Fed. R. Civ. P. 65(b)(2). Absent the adverse party's consent, then, the rule permits a single, fourteen-day extension for good cause. See Granny Goose Foods v. Bhd. of Teamsters & Auto Truck Drivers, 415 U.S. 423, 433 (1974) (explaining, when the rule spoke in terms of ten rather than fourteen days, that "under Rule 65(b), [TROs] must expire by their own terms within [ten] days after entry, [twenty] days if good cause is shown" (footnote omitted)). In this context, good cause exists where, as here, "the parties are awaiting a hearing on a preliminary injunction, i.e., to convert a [TRO] to a preliminary injunction." Diabetic Care RX, LLC v. Express Scripts, Inc., No. 18-61331-CIV, 2018 WL 4511878, at *3, 2018 U.S. Dist. LEXIS 110209, at *8 (S.D. Fla. June 29, 2018). (See Dkts. #11, #12, #13, 14, 16.) The court also finds good cause based on Plaintiff's representations of diligence in using the expedited discovery permitted it, (see Dkt. #10 at 12-13), to identify, notify, and serve Defendants so Defendants have the opportunity to be heard at the hearing. (See Dkt. #15.) See Fed. R. Civ. P. 65(a)(1) ("The court may issue a preliminary injunction only on notice to the adverse party."); Four Seasons Hotels & Resorts, B.V. v. Consorcio Barr, S.A., 320 F.3d 1205, 1210 (11th Cir. 2003) ("In order for a preliminary injunction to issue, the nonmoving party must have notice and an opportunity to present its opposition to the injunction."). Accordingly, for good cause shown, the period for the TRO (Dkt. #10) is EXTENDED such that the TRO will expire at 6:15 P.M. E.D.T. on April 6, 2026. Signed by Judge Julie S. Sneed on 3/13/2026. (AJL)
