Filing 16
ENDORSED ORDER denying without prejudice #15 Motion for Temporary Restraining Order. Plaintiff has not yet complied with #10 the Court's Order by filing an amended complaint. Importantly, "[t]he Federal Rules provide that a 'civil action is commenced by filing a complaint with the court.'" Fischer v. Daniels, No. 205CV414FTM33SPC, 2005 WL 8174973, at *1 (M.D. Fla. Sept. 12, 2005) (quoting Fed. R. Civ. P. 3). Thus, "a motion for a temporary restraining order [or] preliminary injunction is not a properly filed complaint and is insufficient to commence a civil action in federal court." Pollak v. Neal, No. 2:25-CV-585-JLB-NPM, 2025 WL 2573039, at *1 (M.D. Fla. July 30, 2025). "[I]n the absence of a complaint that states a cognizable claim, it is axiomatic that Plaintiff cannot demonstrate a likelihood of success on the merits." Id. at *2. Accordingly, in the absence of a complaint, the #15 Motion is DENIED WITHOUT PREJUDICE. Signed by Judge Paul G. Byron on 2/18/2026. (GML)
