ORDER denying as moot #6 Motion to Appear and dismissing Petitioner's Emergency Petition for Writ of Mandamus (Doc. #1) without prejudice. In his criminal proceeding, Petitioner indicated that he was unable to employ counsel, and thus, the Court appointed counsel to represent him. See Mitchell, No. 6:26-cr-12-PGB-RMN, Doc. 23. Yet, in this action, Petitioner paid the filing fee and retained private counsel. It is unclear if Petitioner is paying counsel, and if so, how he is doing so, or how he obtained funds to pay the filing fee. If Petitioner is going to proceed with private counsel in a civil action, the Court wants to know under oath from counsel if he or she is being compensated, and if so, how.
