July 13, 2026 Opinion or Order Filing 7 ENDORSED ORDER denying #3 Plaintiff's pro se motion for a temporary restraining order and preliminary injunction. The motion violates the Local Rules (available at https://www.flmd.uscourts.gov/sites/flmd/files/flmd-amended-local-rules-effective-november-01-2025.pdf). For example, the motion does not satisfy Local Rule 6.01(a)(2)--which requires the motion to include specific facts supported by a verified complaint, an affidavit, or other evidence demonstrating an entitlement to relief--and Local Rule 6.01(a)(6)--which requires Plaintiff to include a proposed order with his motion for a temporary restraining order. Although courts "give liberal construction" to pro se filings, Albra v. Advan, Inc., 490 F.3d 826, 829 (11th Cir. 2007), pro se parties like Plaintiff still must follow procedural rules, including the Local Rules, see Loren v. Sasser, 309 F.3d 1296, 1304 (11th Cir. 2002). To satisfy Local Rule 6.01(a)(6), the proposed order shall fully comply with Federal Rule of Civil Procedure 65. Additionally, Local Rule 3.01(f) explains that the "unwarranted designation of a motion as an emergency can result in a sanction." Plaintiff filed this case on Friday, July 10, 2026, requesting a ruling by noon on Monday July 13, 2026, ahead of a 5:00 PM deadline for Plaintiff's written or recorded statement to the grievance committee. (Dkt. 3 at 2.) However, according to Plaintiff, he received the second amended notice of grievance committee review alerting him to today's deadline on June 24, 2026, (id. at 2), and further these alleged proceedings began nearly two years ago, (Dkt. 1 at 6-7). "Articulating no valid excuse for the late motion, [Plaintiff] attempts to manufacture an emergency." Bravado Int'l Grp. Merch. Servs., Inc. v. Smith, No. 8:12-CV-613-T-23EAJ, 2012 WL 1155858, at *1 (M.D. Fla. Mar. 27, 2012) (scolding the plaintiff for manufacturing an emergency in violation of the local rules). "It is well-established that a party cannot manufacture an emergency and benefit in its creation by precluding Defendants from an opportunity to respond." Bhd. of Maint. of Way Employes Div. of Int'l Bhd. of Teamsters v. Genesee & Wyoming, Inc., No. 3:23-CV-686-BJD-JBT, 2023 WL 5564994, at *1 (M.D. Fla. July 14, 2023). Because this order resolves a motion for a temporary restraining order, Plaintiff shall comply with Local Rule 6.01(c) by immediately serving on Defendants this order as well as the documents listed in the rule. Plaintiff may submit another motion for a temporary restraining order and preliminary injunction after Plaintiff files a notice with the court showing that the service required under Local Rule 6.01(c) has been effected; however, any such motion shall fully satisfy the Local Rules.
