July 14, 2026 Opinion or Order Filing 8 ENDORSED ORDER denying #2 Emergency Motion for Temporary Restraining Order for failure to comply with Local Rule 6.01(a) and dismissing #1 Complaint without prejudice and with leave to amend by noon on July 16, 2026. The #1 Complaint fails to comply with Rules 8 and 10 of the Federal Rules of Civil Procedure because each count reincorporates all preceding paragraphs, which means that counts II, III, and IV incorporate every preceding factual allegation and every preceding cause of action. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1321 (11th Cir. 2015). Without a proper complaint, the Court is without jurisdiction to grant the relief requested. See Alabama v. U.S. Army Corps of Eng'rs, 424 F.3d 1117, 1128 (11th Cir. 2005) ("[A]n injunction in the traditional sense must be an order that gives some or all of the substantive relief sought in the complaint."); see also Powell v. Rios, 241 F. App'x 500, 505 n. 4 (10th Cir. 2007) ("Absent a properly-filed complaint, a court lacks power to issue preliminary injunctive relief."). The #2 Motion fails to comply with Local Rule 6.01(a) because, among other things, it fails to include a proposed order and it does not include "the reason that notice is impractical." See Middle District of Florida Local Rule 6.01(a). This is not an exclusive list of the defects in the Motion. Counsel is directed to review and carefully comply with the applicable Federal Rules of Civil Procedure and Middle District of Florida Local Rules. Even if the defects in the Complaint had not necessitated dismissal, the defects in the Motion would have necessitated its denial. For guidance to counsel, pinpoint citations, quotations, and/or explanatory parentheticals are typically used to demonstrate how a cited case supports the cited proposition. Although counsel included a certification regarding use of generative artificial intelligence and the certification states that the cited authorities support the propositions for which those cases are cited, on the Court's preliminary review it is unclear how counsel arrived at that conclusion. Because leave is granted to amend the complaint and the motion, counsel is directed to include a pinpoint citation for every cited case. In addition to a pinpoint citation, a citation should also be accompanied by either a quote from the case or an explanatory parenthetical that is sufficient to demonstrate how the case stands for the cited proposition. Finally, when the motion and complaint are amended, (1) both must be verified by petitioner under penalty of perjury and (2) the motion must address how the emergency motion is timely and appropriately considered on an emergency ex parte basis when the petitioner alleges that USCIS denied the petition over six months before this case was filed.
