ORDER transferring case. Self-represented plaintiff, who currently is incarcerated in Florida, brings suit against a litany of defendants, including the President of the United States, the Governor of Florida, and his ex-wife, in connection with an alleged criminal conspiracy amongst the defendants to keep him detained unlawfully on frivolous and unfounded criminal charges. He purports to sue under myriad federal statutory and constitutional provisions, though he does not make any clear request for any specific release. He asks, inter alia, to be released, and so the court construes the complaint as a habeas petition. However, this court does not have jurisdiction to hear a habeas petition from an individual incarcerated in a foreign jurisdiction. A habeas petition brought by an individual in the custody of a state pending trial, as appears to be Mr. Seone's situation, is governed by 28 U.S.C. 2241. Mulkey v. Niagara Cnty. Sheriff, 720 F. Supp. 3d 237, 241 (W.D.N.Y. 2024). But a 2241 petition must be brought in the district in which the petitioner is detained. Ozturk v. Hyde, 136 F.4th 382, 390 (2d Cir. 2025). So this court does not have jurisdiction to grant that relief.Even were the court to construe the pleading as a civil rights complaint, generally speaking, such an action would have to be brought in a judicial district wherein a party resides or within a judicial district where a substantial part of the events giving rise to the action occurred. 28 U.S.C. 1391(b),(e). A review of the complaint shows that there is no allegation that any party resides in Connecticut, and that the events giving rise to the action occurred in Florida. Thus, it is clear that venue is improper here. However, "[a] district court may not dismiss a case sua sponte for improper venue absent extraordinary circumstances." Gomez v. USAA Fed. Sav. Bank, 171 F.3d 794, 796 (2d Cir. 1999). Under 28 U.S.C. 1404(a), though, "a district court may transfer any civil action to any other district or division where it might have been brought...." See also Lead Indus. Ass'n, Inc. v. Occupational Safety & Health Admin., 610 F.2d 70, 79 n.17 (2d Cir. 1979) ("The broad language of 28 U.S.C. [] 1404(a) would seem to permit a court to order transfer [s]ua sponte...."). Accordingly, the court finding that it is in the interest of justice and for the convenience of the parties and any potential witnesses in this matter, this matter hereby is transferred to the Middle District of Florida.
