Petitioner's sentence of death is VACATED.(2) DENIES all claims in the Petition as to the guilt phase.(3) ORDERS Respondent to conduct a new penalty phase for Petitioner to commence within six months from the date of this Orde r, or if an appeal is taken from this Order, within six months of the date this Order becomes final.(4)The Court finds that neither part is entitled to a certificate of appealability. And further, the clerk is directed to enter judgment for Petitioner as to the penalty phase portion of this Order; to enter judgment for the Respondent as to the guilt phase portion of this order; and to close this case.
