ORDER granting in part and holding in abeyance in part 44 Defendants' Motion for Summary Judgment. The motion is granted as to Counts IV and IX of the Second Amended Complaint. The motion is held in abeyance as to Counts I and II. On or before Friday, December 11, 2015, Plaintiff shall file a notice informing the Court of the outcome of the mediation scheduled for December 10, 2015. The Parties (lead counsel AND the individual Plaintiff and Defendants) shall also confirm their availability in person for a hearing on the motion in the afternoon of December 16, 2015.
