(1) The Report and Recommendation of the Magistrate Judge is adopted, confirmed, and approved in all respects and is made a part of this Order for all purposes, including app ellate review. (2) Plaintiff's Motion to Proceed In Forma Pauperis 2 is DENIED, without prejudice. Plaintiff may file an amended motion to proceed in forma pauperis, including a financial affidavit which fully sets forth his income and liab ilities. (3) Plaintiff's Petition 1 is DISMISSED without prejudice. Plaintiff is granted leave to file an amended complaint within twenty (20) days from the date of this Order which clearly set forth a cause of action consistent with the pl eading requirements of the Federal Rules of Civil Procedure and which clearly states the basis of this Court's jurisdiction.
