ORDER: (1) The Report and Recommendation of the Magistrate Judge 11 is adopted, confirmed, and approved in all respects and is made a part of this Order for all purposes, including appellate review. (2) Plaintiff's Amended Complaint [8 ] is DISMISSED without prejudice. (3) Plaintiff's Motion to Proceed In Forma Pauperis 9 is DENIED without prejudice. (4) Plaintiff is granted leave to file a Second Amended Complaint within twenty (20) days from the date of this order which clearly sets forth a cause of action consistent with the pleading requirements of the Federal Rules of Procedure and which clearly states the basis of this Court's jurisdiction.
