August 7, 2018 Opinion or Order Filing 95 ENDORSED ORDER: On July 30, 2018, the Court entered an order granting Defendants' motion to transfer venue to the Southern District of New York. (Doc. #92). That same day, the Clerk transferred the case to the Southern District of New York, where it was opened and given a new case number on July 31, 2018. (Doc. # 93). Yet, on August 5, 2018, Botha filed a motion for reconsideration (Doc. #94) in this Court. Apparently, since the case was transferred to the Southern District of New York, some Defendants have filed a letter with that court, requesting permission to re-brief their pending motions to dismiss and supposedly suggesting that New York state law should apply to Botha's Florida unfair competition claim. (Doc. # 94-3). For that reason, Botha requests that this Court "clarify its Order [to] hold[] that Florida law will continue to control Botha's Unfair Competition claim" and "hold that [the Court] did not countenance, nor does it endorse, a 're-briefing' of motions already fully briefed in the MDFL." (Id. at 10). The Court is unable to grant Botha the relief she requests as this Court no longer has jurisdiction. "It is well established that '[o]nce the files in a case are transferred physically to the court in the transferee district, the transferor court loses all jurisdiction over the case, including the power to review the transfer.'" Bruce Oakley, Inc. v. Vidalia Dock & Storage Co., No. 5:15-CV-57(DCB)(MTP), 2016 WL 6238606, at *1 (S.D. Miss. Oct. 25, 2016)(quoting Schwartz v. Curtis, 2008 WL 4467560, *1 (S.D. Tex. Oct. 2, 2008)); see also Jones v. InfoCure Corp., 310 F.3d 529, 533 (7th Cir. 2002)("Generally speaking, a district court relinquishes all jurisdiction over a case when it is transferred to another district court."). Accordingly, Botha's motion for reconsideration is denied because this Court lacks jurisdiction. To the extent Botha objects to Defendants' request that the New York court allow re-briefing of the motions to dismiss or is concerned how the New York court will handle the choice of law question, Botha should raise those issues with the New York court.
