ENDORSED ORDER: On September 4, 2018, Defendants filed a reply to their motion to dismiss without seeking leave of Court. (Doc. #22 ). Soon thereafter, Plaintiff O'Keefe moved to strike the reply. (Doc. #24 ). Local Rule 3.01(c) states: "No party shall file any reply or further memorandum directed to the motion or response allowed in (a) and (b) unless the Court grants leave." Again, Defendants did not seek leave of Court before filing their reply. Accordingly, O'Keefe's motion is granted and Defendants' reply is stricken. However, the Court notes that O'Keefe's motion did not include a Local Rule 3.01(g) certification. Pursuant to Local Rule 3.01(g), the moving party must confer with opposing counsel in a good faith effort to resolve the issues raised by the motion before filing, and must include a certificate in the motion indicating whether opposing counsel objects. The Court reminds O'Keefe that, although he is proceeding pro se, he must comply with Local Rule 3.01(g) and all other rules lawyers are required to follow in the future. Signed by Judge Virginia M. This document can be found on Judge Covington's page of the Court's website at www.flmd.uscourts.gov. Please be advised that the Court's Case Management Report form is different from those used by other judges. Local Rule 3.05(c)(2)(E), M.D. Fla., explains that most track two cases, like the present case, "will be tried within one year after the filing of the complaint." To accomplish this goal, the Court believes that six to eight months is a sufficient period of time to conduct discovery. If the parties believe that more than eight months will be needed to complete discovery, the parties should provide the Court with a detailed explanation as to why additional time is needed and a timeline for the discovery that is planned.
