This document can be found on Judge Covington's page of the Court's website at www.flmd.uscourts.gov. Please be advised that the Court's Case Management Report form is different from those used by other judges. Local Rule 3.05(c)(2)(E), M.D. Fla., explains that most track two cases, like the present case, "will be tried within one year after the filing of the complaint." To accomplish this goal, the Court believes that six to eight months is a sufficient period of time to conduct discovery. If the parties believe that more time than eight months will be needed to complete discovery, the parties should provide the Court with a detailed explanation as to why additional time is needed and a timeline for the discovery that is planned. The Court will then determine whether a Case Management Hearing is necessary before entry of a Case Management and Scheduling Order. Signed by Judge Virginia M. Hernandez Covington on 9/27/2018. September 26, 2018 Filing 6 AMENDED COMPLAINT BY PLAINTIFF MARY ALFORD against Scottsdale Insurance Company with Jury Demand. filed by Scottsdale Insurance Company.(Seale, Nyasha) Filed in State Court on 9/12/18. Modified text on 9/27/2018 (KMM).
September 25, 2018 Opinion or Order Filing 5 ENDORSED ORDER: Defendant removed this insurance action on the basis of diversity of citizenship on September 20, 2018. (Doc. #1 ). Defendant indicates in the Notice of Removal that it is an Ohio corporation with its principal place of business in Scottsdale, Arizona. (Id. at 1). As for Plaintiff, however, Defendant simply asserts that Plaintiff "owned real [property] located at 2238 E 113th Avenue, Tampa, Florida." (Id. at 8). Neither the Notice of Removal nor the Complaint provide adequate information concerning Plaintiff's citizenship. As explained in Molinos Valle Del Cibao, C. por A. v. Lama, 633 F.3d 1330, 1342 n.12 (11th Cir. 2011), "citizenship, not residence, is the key fact that must be alleged... to establish diversity for a natural person." The parties are thus directed to file a supplement concerning Plaintiff's citizenship by October 4, 2018. Failure to do so will result in an Order remanding this action to state court. Signed by Judge Virginia M. Hernandez Covington on 9/25/2018. (KAK)
