May 24, 2019 Opinion or Order Filing 87 ENDORSED ORDER: On April 4, 2019, the Court, based on a finding that Defendants had committed and were about to commit federal health care fraud offenses, entered a temporary restraining order that, among other things, prohibited withdrawals from Defendant Regency's Wells Fargo bank account. (Doc. #6). On April 16, 2016, the Court extended the temporary restraining order until the entry of an order on the United States' request for a preliminary injunction. (Doc. # 33). Defendant Regency then filed a motion to modify the temporary restraining order, seeking the release of $36,630.49 from its Wells Fargo account to meet outstanding payroll obligations. (Doc. #53). In its response in opposition to the motion to modify the temporary restraining order, the United States represented that all of the funds in Defendant Regency's Wells Fargo account were subject to seizure warrants that had been issued by this court, and it attached copies of two such seizure warrants to its response. (Doc. #67). In any event, the stipulated preliminary injunction entered as to Defendant Regency on May 21, 2019, had the effect of superseding the temporary restraining order. (Doc. #79).
